1. Acceptance of Terms
By registering for or using LoadLink (the "Platform"), you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the Platform. These terms apply to all users including load owners and logistics companies (transporters).
2. Description of Service
LoadLink is a digital matchmaking platform that connects load owners (cargo senders) with registered logistics companies and transporters operating within South Africa. LoadLink does not own, operate, or employ any drivers or vehicles. We are a technology intermediary only.
3. User Accounts
3.1 You must provide accurate and complete information when registering. 3.2 You are responsible for maintaining the confidentiality of your login credentials. 3.3 You must be a registered legal entity or individual 18 years or older to use the Platform. 3.4 LoadLink reserves the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.
4. Load Owners
4.1 Load owners may post loads at no charge during the launch phase. 4.2 Load owners are responsible for ensuring the accuracy of all load details including weight, commodity type, pickup and delivery addresses. 4.3 Load owners are responsible for all payments to transporters as agreed. LoadLink does not process these payments. 4.4 Load owners agree to honour the agreed payment terms with transporters once a job is accepted.
5. Transporters (Logistics Companies)
5.1 Transporters are required to hold all necessary permits, licences, roadworthy certificates, and insurance required by South African law. 5.2 By accepting a load, the transporter confirms their vehicle and drivers are legally compliant. 5.3 LoadLink is not liable for any accidents, losses, damages or delays arising from transport operations. 5.4 Transporters may be required to pay a monthly subscription fee when monetisation is activated on the Platform. The current fee is R1,000 per month per company.
6. Payments
6.1 All payment terms for load transport are negotiated between load owners and transporters directly. 6.2 LoadLink does not act as a payment intermediary between load owners and transporters. 6.3 Subscription fees paid to LoadLink are non-refundable once the billing period has commenced. 6.4 LoadLink reserves the right to change subscription pricing with 30 days' notice.
7. OTP Verification
The 4-digit OTP system is used to confirm physical collection of a load. Both parties agree that a correctly entered OTP constitutes confirmation of pickup and transfers responsibility of the goods to the transporter from that moment.
8. Ratings and Reviews
8.1 Users may rate and review each other after completed jobs. 8.2 Reviews must be honest and based on actual experience. 8.3 LoadLink reserves the right to remove reviews that are fraudulent, abusive, or violate these terms.
9. Prohibited Conduct
Users may not: • Post false or misleading load information • Circumvent the Platform to avoid subscription fees • Harass, threaten or abuse other users • Use the Platform for any unlawful purpose • Attempt to access other users' accounts • Post loads involving illegal goods or substances
10. Limitation of Liability
LoadLink, its directors, employees and agents shall not be liable for: • Any loss or damage to goods in transit • Delays in delivery • Actions or omissions of transporters or load owners • Losses arising from Platform downtime or technical issues • Any indirect, incidental or consequential damages Our maximum liability to any user shall not exceed the subscription fees paid in the preceding 3 months.
11. Intellectual Property
All content, design, code and branding on LoadLink is owned by LoadLink (Pty) Ltd. Users may not reproduce, copy or distribute any part of the Platform without written permission.
12. Governing Law
These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
13. Changes to Terms
LoadLink reserves the right to update these terms at any time. Users will be notified of material changes via the app. Continued use of the Platform constitutes acceptance of the updated terms.
